TERMS AND CONDITIONS OF SALE

Premises

Items for sale on www.elpidioloffredo.com (hereinafter the “Site”) are sold and invoiced by Elsafur Srl, Via Tito Livio, 6 / Citofono 23, 20137 Milano MI, Italy, VAT No. 06804321211.

Elsafur Srl always strives to meet the expectations of its customers and has therefore established a distance-selling service through its website www.elpidioloffredo.com.

The distance-selling service is governed by the general terms and conditions of sale and is reserved exclusively for individual consumers purchasing products for personal use (hereinafter referred to as the “Customer”).

Scope

These General Terms and Conditions of Sale apply to all sales made by Elsafur Srl at a distance worldwide, either (i) by telephone through Customer Service or (ii) through our website www.elpidioloffredo.com.

These General Terms and Conditions of Sale must be carefully reviewed by the Customer before completing a purchase. By placing an order through Customer Service or through the website www.elpidioloffredo.com, the Customer acknowledges having read and fully accepted these General Terms and Conditions of Sale, agrees to comply with the payment conditions described below, confirms that they have read and accepted all information provided, and acknowledges that Elsafur Srl shall not be bound by any other terms or conditions unless previously agreed in writing and signed by all parties.

Sales of customized products are subject to the “Special Conditions of Sale for Customized Products” set out below in this document. In the event of any conflict between these Special Conditions and the General Terms and Conditions of Sale, the Special Conditions shall prevail.

1. Identification of the Seller

1.1 For the purposes of these General Terms and Conditions of Sale, the seller is identified as and hereinafter referred to as “Elsafur Srl”. All products are MADE IN ITALY.

1.2 These Terms and Conditions may be amended at any time. Each Buyer is required to read the Terms and Conditions before making any purchase.

1.3 In any event, the version of the Terms and Conditions in force on the date on which the purchase order is submitted shall apply.

1.4 These Terms and Conditions apply regardless of the Buyer’s nationality, provided that the products are to be delivered to one of the countries for which the Website provides an online sales service, as specified in Section 2.

2.2 The Vendor may extend or reduce the list of countries indicated in Section 2.

2.3 Deliveries can also be made to the Republic of San Marino and Vatican City.

3. How to Buy

3.1 The products offered for sale by Elsafur Srl are exclusively those displayed on the Site at the time the order is placed, as described in the relevant product information sheets.

3.2 The images accompanying the description of a product are for informational purposes only and may not fully reflect all of its characteristics or may differ slightly in colour or size due to the browser, monitor or device used to access the Site.

3.3 The Customer must complete all required fields of the online order form and submit the order after carefully reviewing the conditions and specifications of the product(s) to be purchased. The Customer has the right to request a copy of the invoice for the purchase, in accordance with Article 22 of Presidential Decree No. 633/1972.

3.4 Receipt of the order and confirmation will be sent by Elsafur Srl by email to the email address provided by the Customer. This confirmation message will include a summary of the purchase terms, as required by applicable law, as well as the information entered by the Customer in the order, allowing the Customer to verify its accuracy and promptly report any errors.

3.5 Purchases on the Website are reserved exclusively for individuals acting as consumers who are at least 18 years old.

3.6 “Consumer” means any individual acting for purposes unrelated to their business, commercial activity, trade or profession.

3.7 Purchases made through the Website imply that the Buyer has read and unconditionally accepted these Terms and Conditions.

4. Pre-Contractual Information

4.1 Before purchasing online, the Buyer must complete the Vendor’s online order form and submit it by following the instructions provided.

4.2 Before confirming the order, the Vendor is legally required to provide the Buyer with all information required under Article 49 of the Italian Consumer Code. Information concerning the right of withdrawal shall be provided in accordance with applicable legislation.

4.3 To complete the order, the Buyer must confirm payment for the Products in the shopping cart. After selecting the Products and confirming the Buyer’s details, the Website will redirect the Buyer to the payment system page, where the payment transaction will be processed.

4.4 Any order for which no payment transaction has been successfully registered will automatically be cancelled.

4.5 Upon receipt of confirmation of payment, the Vendor will send the Buyer an email confirming the order to the email address provided during the purchase process, as required by Article 51(7) of Italian Legislative Decree No. 206/2005.

4.6 The offer of products on the Website constitutes a public offer pursuant to Article 1336 of the Italian Civil Code. The completion and successful submission of an order through the Website therefore constitutes acceptance of the offer. The contract shall be deemed concluded when the Vendor receives the Buyer’s acceptance through the order form.

4.7 The Vendor may refuse to accept an order if the credit card or other electronic payment method is not authorised.

4.8 The Buyer may monitor the status of their order at any time by contacting Customer Service through the relevant section or by using the tracking number provided in the shipping confirmation email.

4.9 The Buyer must retain the order number provided by the Vendor and quote it in all correspondence with the Vendor.

4.10 Sales contracts on the Website may be concluded in the following languages:

4.11 Once the Buyer has completed the online purchase, the Terms and Conditions should be retained for future reference. Reading and acceptance of the Terms and Conditions are mandatory steps in the purchase process.

5. Choice and Availability of Products

5.1 The Products offered for sale on the Website are Elpidio Loffredo-branded garments and accessories included in the online catalogue at the time the Buyer places the order.

5.2 The Product catalogue may be updated by the Vendor. The Vendor therefore does not guarantee that a particular product will always remain available online. Under no circumstances can the Vendor guarantee the availability of all sizes or models for each garment or colour.

5.3 Each item in the Product catalogue is accompanied by a description of its main characteristics. Images and colours may not correspond exactly to the actual characteristics of the Products due to the settings of the computer, monitor or device used by the Buyer to view the Website. Images are therefore published for informational purposes only and are subject to normal tolerance limits.

5.4 If the selected Product is unavailable despite having been selected in the order form, the Vendor will promptly inform the Buyer by email and offer termination of the sales contract and a refund of the price, including any delivery costs already paid.

6. Prices and Payment

6.1 The prices displayed on the Website include applicable taxes and VAT. Any additional costs shall be clearly indicated on the Site and/or in the Terms of Sale.

6.2 The following payment methods are available:

  • PayPal

  • SEPA Direct Debit, where available

  • Bank Transfer

6.3 The sale price will be charged in accordance with the payment procedure indicated at the time of purchase.

7. Terms of Delivery, Costs and Other Charges

7.1 The Products will be delivered by courier directly to the Buyer at the delivery address specified in the order.

7.2 The Website allows Products to be delivered to an address other than the Buyer’s address, provided that the address is located within the shipping country selected when placing the order. The Buyer is responsible for providing all information necessary for successful delivery, including, for example, the name displayed on the doorbell when the delivery is made to a third party.

7.3 Products purchased through the Website may also be collected directly from the Vendor’s store, where this service is available.

7.4 Delivery costs and shipping methods may vary depending on the destination country and the shipping method selected by the Buyer, in accordance with the shipping table available on the Website.

7.5 These costs and any additional charges shall be borne by the Buyer. The applicable amount will be indicated separately in the order summary before the Buyer submits the order and in the order confirmation email referred to in Section 4.

7.6 Once the Products have been handed over to the courier, the Buyer will receive a shipping confirmation email from the Vendor indicating the courier and shipping details.

7.7 Delivery times vary depending on the destination country and the shipping method selected.

7.8 In Italy, delivery generally takes between 1 and 5 working days. Delivery times for other countries vary depending on the selected shipping method and are indicated in the shipping table available on the Website.

7.9 Both in Italy and abroad, if the recipient is absent at the time of the courier’s delivery attempt, the courier will leave a notice containing information on how to arrange a further delivery attempt.

7.10 The Buyer may check the progress of their order using the tracking number provided in the shipping confirmation email or by contacting Customer Service.

7.11 The Products shall be deemed delivered when the consumer or a third party designated by the Buyer, other than the courier, takes physical possession of the goods. From that moment, the risk of loss or damage to the Products for reasons not attributable to the Vendor shall pass to the Buyer.

8. Buyer’s Obligations upon Delivery

8.1 The Buyer acknowledges that taking delivery of the Products constitutes an obligation arising from the sales contract concluded with the Vendor.

8.2 If the Products cannot be delivered because the recipient is absent, after the scheduled delivery attempts have been made, the package will be placed in storage in accordance with the courier’s procedures.

8.3 If the package is not collected within the period indicated by the courier, it will be returned to the Vendor.

8.4 In the event referred to in Section 8.3, the contract may be terminated in accordance with Article 1456 of the Italian Civil Code by means of an email notification sent to the Buyer. The order will therefore be cancelled. Within 15 days of such notification, the Vendor will refund the amount paid by the Buyer for the Product, less the costs of the unsuccessful delivery, the costs of returning the Products to the Vendor and any other costs incurred by the Vendor as a result of the Buyer’s failure to receive the delivery.

8.5 Any refund due pursuant to Section 8.4 will be credited using the same payment method used by the Buyer.

8.6 Upon receipt of the Products, the Buyer should verify that they correspond to the order and, in particular, that:

  • the package is intact and has not been damaged or tampered with.

8.7 Acceptance of a package despite visible damage or tampering does not, by itself, result in the loss of the Buyer’s statutory rights. Any claims relating to damage should be promptly reported to the Vendor and, where appropriate, to the courier.

9. Right of Withdrawal

9.1 The Buyer, acting as a consumer, may withdraw from the sales contract in accordance with the applicable provisions of the Italian Consumer Code, without having to provide any explanation or incur any penalty, subject to the applicable conditions and exclusions.

9.2  The Buyer may exercise the right of withdrawal within 7 days from the date on which the Buyer or a third party designated by the Buyer, other than the courier, takes physical possession of the Products.

9.3 In the case of multiple Products ordered in a single order and delivered separately, the period indicated in Section 9.2 shall begin on the date on which the Buyer or the third party designated by the Buyer, other than the courier, takes physical possession of the final Product.

9.4 In the case of delivery of a Product consisting of multiple batches or pieces, the period indicated in Section 9.2 shall begin on the date on which the Buyer or the third party designated by the Buyer, other than the courier, takes physical possession of the final batch or piece.

9.5 Before expiry of the applicable withdrawal period, the Buyer must inform the Vendor of their decision to exercise the right of withdrawal.

  1. The withdrawal period shall be deemed respected if the notice of withdrawal is sent before the expiry of the applicable period.

  2. The Buyer must specify in the withdrawal notice the Product or Products in respect of which the right of withdrawal is being exercised.

  3. Any refund will be made using the same payment method used by the Buyer, unless otherwise agreed.

  4. Having exercised the right of withdrawal, the Buyer must return the Products without undue delay and, in any event, within the applicable return period, by sending them to:

9.6 Products must be returned in their original packaging and must include all ancillary documents, tags, labels, seals, anti-theft devices and any other materials supplied with the Product.

9.7 The Buyer may return the Products using the postal service or a courier of their choice.

9.8 Unless otherwise provided by applicable law, the risks and costs associated with the return shipment shall be borne by the Buyer.

9.9 In accordance with Article 57(2) of the Italian Consumer Code, the Buyer is responsible for any reduction in the value of the Products resulting from handling other than that necessary to establish the nature, characteristics and functioning of the Products.

9.10 If, upon receiving the returned Products, the Vendor determines that their value has been reduced as a result of handling attributable to the Buyer, the Vendor may deduct the corresponding amount from the refund, where permitted by applicable law. The Buyer will be informed accordingly.

10. Legal Conformity Warranty

10.1 All Products sold on the Website are covered by the statutory legal guarantee of conformity pursuant to Articles 128 et seq. of the Italian Consumer Code. This guarantee applies exclusively to consumers.

10.2 The Vendor is legally required to deliver Products that conform to the sales contract.

10.3 The Vendor is liable to the Buyer for any lack of conformity existing at the time of delivery, in accordance with applicable law.

10.4 In order to exercise their rights under the legal guarantee, the Buyer must report any lack of conformity to the Vendor in accordance with the applicable statutory time limits by contacting Customer Service through the relevant section. The notification should contain a complete and accurate description of the defect or lack of conformity.

10.5 Customer Service will respond to the Buyer’s notification and provide instructions on how to return the defective Product. Where required by applicable law, the return costs shall be borne by the Vendor.

10.6 The Vendor may ask the Buyer to include the invoice or other document proving the purchase together with the Product concerned.

10.7 Where the legal guarantee of conformity applies, the Buyer shall be entitled to the remedies provided by applicable law, including repair or replacement of the Product, unless the requested remedy is objectively impossible or disproportionately costly compared with the alternative remedy.

10.8 The Buyer may request an appropriate reduction in the price or termination of the sales contract where the conditions provided by applicable law are met, including where repair or replacement is impossible, disproportionately costly, not carried out within a reasonable period, or causes significant inconvenience to the Buyer.

10.9 A minor lack of conformity shall not give rise to the right to terminate the contract where the applicable law provides otherwise.

10.10 The legal guarantee does not cover defects or damage resulting from accidents, improper use, negligence or fault attributable to the Buyer, or normal wear and tear.

11. Privacy

11.1 The Buyer’s personal data will be processed in accordance with applicable data protection legislation, as described in the Privacy Policy provided to the Buyer during the registration and/or purchase process.

13. Customization

13.1 It is possible to request the tailor-made production of a fur garment. Customized or tailor-made Products cannot be returned or cancelled where excluded by applicable law.

13.2 It is possible to request personalization of a fur coat. Customization may include:

  • Fur garment length

  • Sleeve length

  • Collar and pocket modifications

  • Lining colour and various accessories

  • Addition of accessories

  • Initials on the lining
